 A Trademark registration in India is governed by the Trademarks Act, 1999 and Trade Marks rules, 2002. It regulates the registration of goods and services under the trademark act. The grounds for granting registration or rejection of trademark is primarily government by Section 9 and 11. 1. How much does it cost to register a trademark in India?

The cost to register a trademark varies on the basis of whether the trademark application is to be made in the name of the Individual (Sole Proprietor) or in the name of the Partnership firm or Private Limited Company or Limited Liability Partnership (LLP). The government fees for registering a trademark in the name of an Individual is 4,500/- per Class, Private Limited Company, LLP and Partnership firm is 9,000/- per Class(Note: This will reduce by 50% if the applicant is registered under Udyam Registration or in case of a Private Limited Company it is recognised as a Startup under Startup India Programme Initiative and the startup recognition certificate is issued under Department of Industrial Policy and Promotion (DIPP). The professional Fees for each class will vary from service provider to service provider. 

2. How long is a trademark protected?

The trademark once applied in valid for 10 years and gets renewed when the renewal application is filed. Note: The discount on the government fees will not be available for the renewal application will be at full fees of whatever the fees that may be at that time. 

3. What is the "R" "TM" stand for and when can it be used ?

The "TM" can be used on application of brand name or Logo till it is registered. The Letter "R" is used when the Brand name or Logo is accepted and the registration certificate is issued by the Trademark Registry.
